Article 33 explained in plain English
This article protects the funds of minors and those treated like them from exploitation by those who work at the Authority, and sets two prohibitions:
Whom does the prohibition cover? The members of the Authority's Board of Directors, its staff, and those who represent it.
The first prohibition: secrets
They may not disclose anything they learned of the Authority's secrets by virtue of carrying out its work.
The second prohibition: dealing in the covered persons' funds
- They may not buy or lease any of the funds of those covered by the Law.
- Nor sell or lease to the Authority, in that capacity, any of their own property, or exchange it with the Authority.
- Whether this is done directly or indirectly, even by public auction.
- Nor may they enter, in a personal capacity, as a party to any contract the Authority executes or supervises.
The sanction: any dealing made in breach of this article is void.
Note that the provision closes the roundabout routes: the prohibition covers indirect dealing, and it is not lifted because the sale is at public auction. In addition to voidness, Article 34 sets a penalty for anyone who breaches the provisions of this Law: a fine not exceeding SAR 100,000 and imprisonment for a period not exceeding 30 days, or either of these penalties.
If you learn that one of the Authority's staff bought or leased a minor's property, you can consult a lawyer who specializes in personal status and estates to learn how to claim that the dealing be voided.
Practical example
The Authority put land owned by orphans up for public auction, and an employee of the Authority bought it in the name of a relative. This dealing is prohibited because the prohibition covers the indirect route even where the sale is by public auction, and the sale is void for breaching this article.
