Article 22 explained in plain English
This article deals with a special case: a military member who suffers harm because of the conditions of the place where he was ordered to serve.
Cases covered: a person who suffers total or partial disability, or dies, because of:
- weather conditions, or
- environmental diseases,
in a place he was ordered to serve in. The condition is that service in that place was by order, not by his personal choice.
How is he treated? As the case may be:
- In disability: he is treated under Article 17, which grants a person with total disability during and because of his work a pension equal to the last salary he was receiving, and a person with partial disability that required his discharge from military service four-fifths of the last salary, with cases of disability determined by decision of the Military Medical Committee approved by the Minister.
- In death: he is treated under paragraph (a) of Article 20, which grants the beneficiaries of a military member who dies during and because of work a monthly pension equal to the salary he was receiving at death.
The article therefore treats harm caused by weather or environmental diseases at the place of ordered service as equivalent to a work injury. Note that it refers to paragraph (a) of Article 20, not paragraph (b) on martyrdom.
This article follows Article 21, which makes the Military Medical Committee responsible for establishing injuries and deaths, with a report from the formation commander sufficing in war. Someone harmed in such circumstances may consult a lawyer who specializes in administrative cases to assess his right.
Practical example
Private Hamad is ordered to serve in a place with difficult environmental conditions and contracts an environmental disease that causes a total disability. Under this article he is treated under Article 17, so he is granted a monthly pension equal to the last salary he was receiving, after the disability is determined by decision of the Military Medical Committee approved by the Minister.
