Article 1 explained in plain English
This is the definitions article, and it is the key to understanding the rest of the Law, because each term defined here carries the same meaning wherever it appears in the Law unless the context requires otherwise.
The authorities:
- The Ministry: the Ministry of Culture, and the Minister: the Minister of Culture.
- The Commission: the Heritage Commission, and the Board: the Commission's board of directors.
- The Regulations: the Implementing Regulations of the Law.
The core concepts:
- The craftsperson: any natural or legal person who practices a craft or handicraft. The definition covers individuals as well as entities such as companies and establishments.
- The National Register of Craftspeople: a database in which the data of craftspeople, their classifications, crafts, handicrafts and activities are recorded, along with other information the Regulations specify.
- The craft license: the license that entitles its holder to do one of two things: practice a specific craft or handicraft for commercial purposes, or trade as a main activity in handmade craft products.
The definition of the craft license shows that it is tied to a commercial purpose or to trading as a main activity, which clarifies when a person needs this license.
The meaning of "craft and handicraft" itself is addressed by Article 2, which defines it as any activity based mainly on manual work that draws its designs from the cultural heritage handed down in the regions of the Kingdom, or that provides services related to craft products, and divides it into an artistic or heritage production category and a service category.
