Article 6 explained in plain English
This article sets out how the application to register a geographical indication is submitted and what it contains. The application is submitted to the Saudi Authority for Intellectual Property on the form prepared for that purpose, and must include:
- What shows that the product is tied to a particular geographical region, and that its quality, reputation or other characteristics are essentially attributable to that region. This is the core idea of the geographical indication as defined in Article 1.
- For a foreign indication: what proves its protection and use in the country of origin, and what proves that the applicant owns the right to use it or is the competent body supervising it.
- The usage guide, in accordance with the elements set out in Article 8, which are: the product name, its description with its characteristics, quality, components and region of production, a description of the production method, and any other elements set by the Regulations.
- Any other data set by the Regulations.
It is preceded by Article 5, which sets out the substantive conditions for the indication, and the application must show that they are met. It is followed by Article 7, which allows the Authority to request an authentication certificate from the competent authorities in the country of the applicant for a foreign indication.
Practical example
A cooperative association of producers of an agricultural product in a region of the Kingdom wants to register the name of its region as a geographical indication. It must submit the application to the Authority on the prescribed form, with what shows that the product's quality is essentially attributable to the region, and the usage guide containing the product's name, description and method of production.
