Article 20 explained in plain English
This article allows any interested party to ask the competent court for an order to take one or more appropriate precautionary measures, to protect their right before the harm gets worse.
The article lists these measures, without limiting them, as shown by the phrase "including":
- A detailed description of the alleged violation, the products concerned, and the materials, tools and equipment used or to be used in it, and preserving the evidence.
- Precautionary seizure of the items mentioned in item 1, and of the proceeds of the alleged violation.
- Preventing the violating products from entering the markets and from being exported; this includes imported products as soon as they are released from customs.
- Stopping the violation or preventing it from occurring.
Note that the text speaks of an "alleged" violation: a precautionary measure is requested before the final ruling on whether the violation is established. The measure is also issued by order of the court, not by decision of the interested party itself. The article does not set other conditions or guarantees for accepting the request.
It is preceded by Article 19, which makes the competent court the authority hearing violations, disputes and compensation claims. It is followed by Article 21, which sets the penalties for violating acts. Because these measures call for speed and precision, the interested party should consult a lawyer who specializes in intellectual property.
Practical example
An association of producers learns that a shipment of imitation products bearing its geographical indication has arrived at the Jeddah port. It may ask the competent court for an order preventing these products from entering the markets once released from customs, and for a precautionary seizure of them.
