Article 14 explained in plain English
This article regulates cancelling a geographical indication from the register in three paragraphs.
1. Cancellation by court judgment: the competent court, at the request of an interested party, may rule to cancel in the following cases:
- A violation of Article 5 of the Law has been committed.
- The circumstances on which the indication was founded have ceased to exist or changed.
- It is established that the registration was based on fraud or incorrect information.
The Authority cancels the registration after the judgment becomes final.
2. Cancelling a foreign indication by decision of the Authority: the Authority issues the cancellation decision if the protection has lapsed in the country of origin. A grievance may be filed before the committee within 30 days of notification. If the committee does not decide within 60 days of receiving the grievance, or rejects it, the aggrieved party may object before the competent court within 60 days of the end of the period or of being notified of the rejection of the grievance.
3. Making the cancellation public: the cancellation is made public after the court judgment becomes final, or after 30 days have passed from notification of the Authority's decision in paragraph 2 without objection to it.
Note that the period for a grievance against cancelling a foreign indication is 30 days. A person whose indication faces cancellation should consult a lawyer specializing in intellectual property.
Practical example
A producer in a region of the Kingdom found that a registered geographical indication for a similar product had been registered on the basis of incorrect information about the production region. As an interested party, he may ask the competent court to rule to cancel it, and the Authority cancels it after the judgment becomes final.
