Article 9 explained in plain English
After Article 8 required food establishments to register themselves with the Authority, this article requires them to register their food products as well.
The article contains three elements:
- The obligation: a food establishment must register its food products with the Food and Drug Authority.
- Conditions and procedures: set by the Implementing Regulations, and not stated in the law.
- Exemptions: the Regulations also determine the materials exempt from registration, so not every product is necessarily subject to it, but knowing what is exempt depends on what the Regulations decide.
This provision complements what comes before and after it: Article 8 requires the establishment itself to register, this article requires it to register its products, and Article 10 requires laboratories that deal with food to register.
A food establishment under Article 1 is any legal entity that carries out work relating to handling food, and handling includes the practices food goes through during the food chain, including storing, transporting, displaying and selling.
For that reason any factory, importer or trademark owner should make sure its products are registered, or fall within what the Regulations exempt, before putting them on the market.
Practical example
A small factory in Taif produces new kinds of flavored honey. Before distributing them to stores, it registers these products with the Authority according to what the Regulations specify, as this article requires.
