Article 10 of the Saudi Fertility Units Law

This article establishes the doctor's responsibility in fertilization, embryo and infertility treatment units, and it has three features:

• Full responsibility: the text does not make it partial or limited.
• For all damage: without specifying a particular type of harm.
• Based on error: the responsibility is tied to damage caused by the doctor's error in treatment, so there must be an error by the doctor, and the damage must result from that error.

This article connects to Article 9, which requires units to organize sperm, eggs, zygotes and embryos precisely and to take the utmost care against their mixing or substitution. It is followed by Article 11, which widens the circle of responsibility to include the doctor, the assistant and the technician for any negligence, shortcoming or error each commits that leads to the mixing or substitution of sperm, eggs, zygotes or embryos. Article 10 is thus general about treatment errors, and Article 11 is specific to mixing and substitution.
