Article 47 explained in plain English
This Article is a list of the matters that the Law left to the Implementing Regulations. It does not lay down detailed rules itself; it shows where the reader can find the details.
According to the text, the regulations determine:
- The controls and procedures for applying environmental principles.
- The requirements, controls, procedures, measures and standards needed to protect environmental media, develop them and rehabilitate them.
- The requirements and procedures for managing rangelands and forests and investing in them.
- The requirements, controls and procedures relating to: receiving reports of environmental emergencies and disasters and dealing with them within the limits of the relevant authority's legally prescribed jurisdiction; supervision of environmental compliance and environmental inspection; measurement and control of noise pollution; managing the marine and coastal environment in its environmental aspects; hunting live wild animals; the strategic environmental assessment study, the environmental impact assessment study and the environmental audit study; every type of permit and license required in the environment sector and for activities that have an environmental impact; and publishing environmental information and data.
- The environmental requirements and controls relating to water injection.
- The controls and procedures for determining the financial consideration for each type of permit and license and for services relating to the environment sector.
- The controls relating to the basis for calculating compensation.
- The controls and procedures for preparing a plan for preparedness and response to environmental emergencies and disasters.
The practical benefit is that anyone looking for details on these matters, such as the amount of a permit fee, the permitted noise limits or the requirements of an environmental impact assessment study, will not find them in the text of the Law but in the Implementing Regulations. The content of those regulations cannot be taken from this Article itself.
This Article comes after Article 46, which makes the provisions of the Law and the regulations the minimum for protecting the environment, and before Article 48, which requires the Minister to issue the regulations within no more than 180 days of the Law's publication in the Official Gazette, to take effect from the date the Law comes into force.
