Article 7 explained in plain English
This article explains what happens after an enforcement request statement is submitted:
- Registration and referral: If the statement meets what Article 6 requires, the competent department in the Court registers it and refers it immediately on registering it to the enforcement circuit.
- Non-registration for incompleteness: If the department decides not to register the statement because of a deficiency, the person seeking registration must make up what is missing within 20 days of being notified. If they do not do so within it, the request is considered as if it had not been made.
- Grievance: The person seeking registration may file a grievance with the president of the Court against non-registration within 15 days of the date the request is considered as if it had not been made, and the president of the Court decides the grievance within 15 days of the date it was filed, and the decision is final and not open to objection.
Article 6 requires the statement to include the details of the person filing the request or their representative, the instrument's details, and the details and attachments specified by the Regulations, so knowing these requirements in advance spares the applicant rejection and lost time.
Note that the grievance deadline starts from the date the request is considered as if it had not been made, not from the date of notification of the deficiency. Article 8 follows, which requires demanding performance from the debtor before filing the enforcement request and sets periods for that.
If you have a specific case, it is best to consult a lawyer specialized in administrative cases and enforcement cases before the Board of Grievances.
Practical example
Saad submitted an enforcement request statement that was incomplete in the instrument's details, and the Court's administration notified him of non-registration. He has 20 days from notification to make up the deficiency. If they pass without making it up, his request is considered as if it had not been made, and he may file a grievance before the president of the Court within 15 days of that date.
