Article 19 explained in plain English
This article allows the Enforcement Circuit to distribute the work: it may assign the administrative body requesting enforcement, or others, to carry out whatever enforcement procedures it sees fit.
But this assignment has two exceptions in which it is not permitted, namely the procedures set out in:
- Article 17: the order to disclose and attach the assets of the party against whom enforcement is sought, including his dues owed by administrative bodies, and the order banning him from traveling or barring administrative bodies and financial institutions from dealing with him.
- Article 20: imposing a fine not exceeding ten thousand riyals for each day that passes without enforcement being completed, other than in enforcement to collect sums of money.
The meaning is that these procedures, which affect a person's funds and his freedom to travel and to deal, as well as the fine, remain in the hands of the Enforcement Circuit itself and are not assigned to the enforcement requester or to anyone else. As for everything else, the Circuit may assign it to whomever it sees fit.
This article comes after Article 18, which applies the procedures of the Enforcement Law where there is no specific provision and gives enforcement circuits the powers of the enforcement judge.
If you have a specific situation, it is best to consult a lawyer specialized in administrative and enforcement cases before the Board of Grievances.
Practical example
In enforcing a judgment in favor of a government body against Salman, the Enforcement Circuit assigned the body itself to carry out some of the enforcement procedures the Circuit saw fit. But disclosing and attaching Salman's assets or banning him from traveling are procedures under Article 17, which this article excludes from assignment.
