Article 3 explained in plain English
This article describes the role of the Ministry of Energy in the electricity sector, without prejudice to the powers of other government bodies established by law. To achieve the objectives of the law, the Ministry is responsible for the following:
- Policies and strategies: preparing them and submitting them for approval, then supervising the relevant bodies as regards the parts that concern them.
- Plans, studies and development programs: preparing them in coordination with the relevant bodies, issuing and updating them, and making sure they are carried out.
- The long-term plan: the Ministry prepares it in coordination with the Authority and approves it. It includes determining the type of fuel available, the contribution share of energy sources in the optimal mix, grid interconnection and reinforcement and bringing service to unserved areas, and maintaining a suitable reserve of generation capacity and spare capacity in the transmission and distribution networks.
- International representation: representing the Kingdom in local, regional and international organizations, including on electrical interconnection and commercial electricity exchange. The Ministry may delegate this to other government bodies.
- Crises: if a situation arises, or is about to arise, that threatens fuel or electricity supplies, the Ministry has temporary exceptional powers to control electricity resources and fuel stocks held by licensees, in coordination with the relevant bodies.
- Localization and local content: a long-term program to support ancillary national industry and the localization of technology and jobs, with particular attention to small and medium enterprises.
- Research, following up on rationalization and efficiency programs, databases and statistics, and proposing amendments to the law in coordination with the Authority.
The Ministry therefore sets policy and planning, while the Authority handles regulation. Article 4 provides that the Authority carries out its tasks on the basis of the policies and strategies approved under this article. Licensees should note in particular that the Ministry's exceptional powers in a crisis may extend to their resources and fuel stocks.
