إذا وقع ادعاء الممانعة فيما يختص بعدم إعطاء بدل المزاد بعد أمر تقرر بظرف ثلاثة أيام فيقبل أما إذا وقع بعد ذلك فلا يقبل وإنما إذا كانت الأثمان الحاصلة هي أكثر من مطاليب الأشخاص الذين سببوا الضبط والبيع فحينئذ تعتبر دعاوى الممانعة الواقعة بعد الثلاثة أيام على الوجه المحرر فيما يختص بزيادة الثمن وفضلته فقط.
