Article 175 explained in plain English
In principle the Civil Aviation Law concerns civil aviation, but this article extends some of its provisions to military aircraft in specified cases.
1- To all national and foreign military aircraft while flying in air corridors or using civil airports in the territory, the following Articles apply:
- 37: using announced civil airports and observing their rules, and not landing elsewhere except in emergency cases under the Regulations;
- 89: the rules of the air, air routes and corridors, and the responsibilities of the aircraft commander set by the Authority;
- 90: prohibiting or restricting flight over certain areas, or over the territory in exceptional circumstances, and dangerous areas and prohibited activities.
2- To foreign military aircraft flying and landing in the territory, and subject to paragraph 1, the following Articles also apply:
- 6: the Authority's right to inspect aircraft, bar them from flying and hold their documents to monitor implementation of the Law;
- 7: the right of customs, security, passport, quarantine and agricultural officials and others to inspect aircraft and the persons and things on them within their competences, in the presence of a representative of the Authority;
- 12: not carrying dangerous materials except with the Authority's permit and under the Regulations' procedures.
So national military aircraft are subject to paragraph 1 only, while foreign ones are subject to both paragraphs. It is followed by Article 176, which requires an agreement and a special permit for a foreign military aircraft to fly or land. This article addresses official bodies mainly; anyone with a question about it may refer to a lawyer specializing in international cases.
