Article 9 explained in plain English
After Article 8 identified the Board of Grievances courts, this article explains how these courts do their work: through "specialized circuits". A case is not heard by the court with all its judges, but by one of its circuits.
- Circuits of the Supreme Administrative Court: Each consists of three judges.
- Circuits of the administrative appeal courts: Each consists of three judges.
- Circuits of the administrative courts: The rule is three judges, and a circuit may consist of a single judge. This permission is given to the administrative courts alone.
The circuits of the administrative appeal courts and of the administrative courts are formed by the Administrative Judiciary Council on the proposal of the court presidents. The article does not say who forms the circuits of the Supreme Administrative Court, nor does it specify the cases in which an administrative court circuit consists of a single judge.
Article 10 then governs the Supreme Administrative Court as to its seat, composition and general assembly. This article helps a litigant understand that the case is heard by a specialized circuit, and that the number of its judges differs according to the level of the court.
