Article 11 explained in plain English
This article gives the Supreme Administrative Court jurisdiction to hear objections to judgments issued by the administrative appeal courts. The key point is that an objection is not accepted on any ground whatsoever; the subject of the objection must be one of the grounds the article sets out:
- Violation of Sharia or the laws: Violation of the provisions of Islamic Sharia or of the laws that do not conflict with it, or error in applying or interpreting them, including violation of a judicial principle established in a judgment issued by the Supreme Administrative Court.
- Lack of jurisdiction: The judgment was issued by a court without jurisdiction.
- Defect in composition: It was issued by a court not constituted in accordance with the law.
- Error as to the facts: Error in characterizing or describing the facts.
- Conflicting judgments: The judgment decided a dispute contrary to another judgment previously issued between the parties to the case.
- Conflict of jurisdiction between the Board's courts.
This article is linked to Article 10, which governs the Supreme Administrative Court, including referral of the objection to the general assembly if one of the circuits considers departing from an earlier principle. The deadlines for filing the objection and its procedures are not stated in this article, which is limited to its grounds.
Because choosing the right ground for an objection requires careful legal judgment, anyone against whom an appeal judgment has been issued is best advised to consult a lawyer specialized in administrative cases.
Practical example
An administrative appeal court issued a judgment against a contracting company in Jeddah, and the company believed the judgment decided a dispute on which another judgment had already been issued between it and the same government body. This is one of the grounds that permit an objection before the Supreme Administrative Court under this article.
