Article 13 explained in plain English
This article regulates organic farming, in five paragraphs:
- The Ministry's jurisdiction: Without prejudice to the jurisdiction of other authorities, the Ministry supervises, oversees and regulates the activity of organic farming, and approves and licenses organic certification bodies.
- The organic certification: Anyone who wishes to practice organic farming must obtain this certificate from the certification bodies.
- The role of the Saudi Food and Drug Authority, in coordination with the Ministry, in preparing:
- The conditions and procedures for inspecting and analyzing organic products.
- The labeling requirements, and the data required on the product card.
- The requirements for importing and exporting organic products.
- The ban on misleading: It is prohibited to place any word, phrase, logo or label on a non-organic product to indicate that it is organic.
- The Implementing Regulations: They set the controls, conditions and standards relating to organic farming inputs and products.
Paragraph 4 protects the consumer directly: the ban covers any means of indication, whether a word, logo or label, so it is not enough to get around it with phrases that suggest the product is organic. This links to the product card regulated by the provisions of the Law.
In practice, anyone who wants to market products as organic first needs the organic certification from an approved certification body, while complying with the labeling requirements the Authority prepares.
If you have a specific situation, it is best to consult a lawyer specializing in agricultural and environmental laws.
Practical example
A small farm in Taif grows vegetables without chemical pesticides, and its owner wants to write the word "organic" on its packaging. To practice organic farming he must obtain the organic certification from an approved certification body, and observe the ban on placing any word on a non-organic product to indicate that it is organic.
